Seller – Dowlings Sewing Machines |
| 1.02 |
Buyer – The individual or business
purchasing goods or services from the seller. |

Goods – The items or services for sale by the
seller. |

Contract – The contract between the seller
and buyer in relation to the sale and purchase of goods or service
as bound by these terms and conditions. |

| 2.00 |
Terms and Conditions of Sale: |
| 2.01 |
Details of address and your Personal details are
kept private and will never be available to a third party. When processing
payments online via a card, the details are kept through you, the
buyer and Secpay. No card details are downloaded onto our computers. |
2.02 |
These terms and conditions shall apply to all contracts
for the sale of goods or services by the seller to the buyer. |

Acceptance of delivery of the goods or services shall
be deemed conclusive evidence of the buyer’s acceptance of those
terms and conditions. |
| 2.04 |
Where the goods or services ordered by the buyer
are not available from stock the buyer shall be notified and given
the option to wait until available or cancel the order and receive
a full refund. Goods or services that are available from stock we
will attempt to send out on the same day of order. |
| 2.05 |
Goods and services will by posted by either 1st class
post or courier for larger products.
· Delivery for parcels will usually be Monday to Friday except
for premium rates, including specific times and weekend delivery. |
| 2.06 |
The Price of the Goods or Services is set on the
Seller's Website. The sale price is in UK Pounds and includes VAT
except in cases where the item carries VAT exemption. The price does
NOT include Carriage, which will be added to the final price at the
check out. At this point the total purchase price, including VAT and
delivery charges will be displayed in the Buyer's shopping cart before
confirming and payment. |

Once the order is received, the Seller will confirm
by email the details, description and price for the Goods or Services
ordered. If these are different from the Buyers details, description
and price shown on the Website the Buyer shall be entitled to cancel
the order. |
| 2.08 |
Specifications, Literature and illustrations of products
are what we the seller believe accurate. However changes can occur
where we reserve the right not to be held responsible for errors or
omissions displayed on the product price or details found on our website.
Colours may also be vary to those found on screen or when printed.
This is especially evident in the threads we sell. |
| 2.09 |
Dispatch of the Goods or Services will only be carried
out once full and cleared payment has been received for the Goods
and Services. |
| 2.10 |
The Seller reserves the right to alter the price
and specification of any item or to withdraw any goods on/from the
Website at its own discretion |
| 2.11 |
Delivery of the goods and services under £30
within the UK will be charged at £3.50, Purchases to be delivered
within the UK over the £30 limit will be delivered free of charge.
However delivers other than those offered by royal mail or the post
office to Northern Ireland and the Highlands of Scotland will need
to pay the supplementary postage charge of £15. Deliveries outside
the UK will vary and the Buyer will be contacted with the Postage
costs. Any Import duty and taxes relevant to the country of import
are at the responsibility of the buyer. |
| 2.12 |
Goods or Services supplied within the UK mainland
will normally be delivered within 7 working days or sooner of receipt
of order and cleared funds. Goods or Services supplied outside the
UK mainland will normally be delivered within 14 working days or sooner
of receipt of order and cleared funds. This does not apply to Special
Order Goods and Services whereby delivery times will be advised to
the Buyer by the Seller at the time of order |
| 2.13 |
Where a specific delivery date has been agreed between
Buyer and Seller and this cannot be met, the Buyer will be notified
and given the opportunity to agree a new delivery date or receive
a full refund |
| 2.14 |
Delivery of the Goods or Services will be made to
the Buyer's credit card / debit card address specified or to an alternative
address if this has been agreed between the Buyer and Seller. The
Buyer must make all arrangements necessary to take delivery of the
Goods or Services, if this is not possible then the Seller should
be notified immediately otherwise any costs incurred to the Seller
will be passed on to the Buyer.
· Risk relating to the goods or services will pass to the buyer
upon delivery of the goods or service. |
| 2.15 |
The Buyer will inspect the Goods or Services immediately
upon receipt and should notify the Seller within 24 hours of delivery
if the Goods or Services are damaged or do not comply with the order.
If the Buyer fails to do so the Buyer shall be deemed to have accepted
the Goods or Services |
| 2.16 |
Where the Goods or Services are defective or damaged
the Buyer should return them to the Seller. The Buyer shall be entitled
to a full refund (including delivery costs) plus any return delivery
charges (upon the Seller receiving proof of delivery costs from the
Buyer) if the Goods or Services are found to be damaged or defective
as long as the Seller has been notified within 24 hours of delivery
and the Seller being satisfied that the damaged had been caused during
transit and that it had been signed for "as damaged" upon
receipt and is not the result of Buyers abuse. |
| 2.17 |
Where returned Goods are found to be damaged due
to the Buyer’s fault the Buyer will be liable for the cost of
repair and all restocking costs |
| 2.18 |
You will need to call us on 01268 570248 for authorisation
to return the products. |
| 2.19 |
The Buyer has the right to cancel the Order at
any time and receive a refund by informing us by phone on 01268 570248
or by email within 24 hours of receipt of the Goods or Services to
authorise return. Goods or Services must be returned at the Buyers
cost and should be adequately insured during the return journey. The
Buyer will receive a refund of all monies paid for the Goods (excluding
delivery charges) less a restocking fee no more than £45.00
to cover replacing any missing items from the order, damage suffered
in transit or negligence. The Goods or Services must be returned unused
and in its original packaging and state with all instructions. Memory
cards, Designs CDs and any software must be unopened and any security
seals and/or shrink warp must be intact. |
| 2.20 |
Warranty:- If the products that you purchase from
us are to be faulty you should notify us in writing within the 12
months of delivery, (except Brother machines which have a 24 month
return to base warranty) The warranty does not apply to software and
does not apply to faults that have been caused by miss-use and/or
neglect of the goods or by accidents caused while the products are
in your possession. Machines are for normal domestic use only and
should be well maintained and serviced. The warranty does not cover
consumable items such as bobbins, blades, needles and needle threaders,
that are stated on the manufactures guarantee document. |

The Seller is entitled to change these Terms and
Conditions at any time |
| 2.22 |
These Terms and Conditions are subject to English
law and the jurisdiction of the English courts. The Buyer's statutory
rights are not affected in anyway. |

Force Majeure: |
| 3.01 |
The Seller will not be liable for any delay or failure
to perform any of its obligations if the delay or failure results
from events or circumstances outside its reasonable control, including
but not limited to acts of God, strikes, accidents, war, fire, technical
failure, acts of terrorism and the Seller shall be entitled to a reasonable
extension of its obligations. |
